Please read these Terms and Conditions ("Terms", "Terms and Conditions”) carefully before using the https://aiclo.pro website (the “Service") operated by Aiclo ("us", "we", or “our”). Aiclo Service is based on the software developed by us (Aiclo Software).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Provision of Service
Aiclo provides drawing and automation of apparel design, pattern development, downloading of ready-made patterns. Both patterns created with Aiclo and patterns downloaded from the library of ready-made patterns on the website aiclo.pro can be used for resale and tailoring.
Privacy
Your use of http://aiclo.pro is subject to Aiclo's Privacy Policy. Please review our PrivacyPolicy, which also governs Aiclo Service and informs users of our data collection practices.
Service Account
When you create a Service Account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You may only create or maintain one Service Account and you agree that the operation of your Service Account is exclusive to you. Furthermore, you agree that only you will receive the Service via your Service Account. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. Any losses incurred or sustained by you when transmitting information by means of email or other Internet link shall be borne solely and exclusively by you
and in no event shall any such losses in whole or in part be borne by Aiclo. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Prices and payment
Prices charged are as shown on the website in US dollars. We may change the price of the Service before you place an order for the Service provision. You can pay for the patterns, subscriptions and for any our packages of services with any bank card or via PayPal payment system.
In order to make a purchase, you may be asked to provide certain information that will allow us to process and authorize your purchase, including, but not limited to, your name, address, card number, card expiration date, card security code, and other information. You represent and warrant that (i) you have the legal right to use the form of payment you are using, and that (ii) the information you provide with this form of payment is true, accurate and correct. You acknowledge that we may use a third party to process or facilitate any payment, and that by providing us with your information, you grant us the right to provide that information to such third parties.
All subscriptions will automatically renew at expiration unless your subscription is canceled before the end of the current subscription period. After all automatic renewals, your registered card will be automatically charged for the next subscription period. You hereby authorize us and our agents (including payment processors which we may use) to collect such payments from your card on your behalf.
Cancellation and refund policy
Refunds or credits for any vector file download, template purchase, textile print design, or any other content on the site or subscription are not available at any time. We also do not refund funds for services that you have already used. You can cancel your monthly subscription at any time, the availability of the service will continue until the paid period of time. You will not be charged in the future after cancellation. If you have chosen an annual subscription, you can cancel it after a year. After you cancel your subscription, you won't be charged for your plan's next billing cycle. You can continue to use the services allocated to your plan until the last day of your paid subscription. After that, you will be automatically transferred to a free account, and your services, features and designed templates will be limited to the features of a free account.
There is no obligation to provide a refund or credit in situations like the following:
- you have changed your mind about a pattern, style, measurements, textile design;
- the pattern fits differently than you expected;
- you do not have sufficient expertise to sew the pattern or work with any of the vector files, textile prints or anything else on the site;
- you can no longer access the pattern because it has been removed;
- 3D body model looks different than your or your client's body;
- 3D design simulation looks different from the item in the real-life;
- one of the services, category or a pattern is not available for use
- you do not like the Aiclo.pro service
Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your Service Account, you may simply discontinue using the Service.
Intellectual property and safety
Except as expressly permitted by these Terms or as permitted by applicable law, you may not (i) use, copy, modify, reverse engineer, disassemble, decompile, modify or transfer our Services or the Aiclo Software or otherwise attempt to derive the source code of our Services or Aiclo Software; (ii) translate, adapt, arrange or create derivative works based on or otherwise modify our Services or the Aiclo Software or any elements thereof for any purpose.
Liability
In relation to the purchase of the Services, we accept no liability for any indirect or consequential loss or damages or for any loss of data, profit, anticipated savings, revenue or business (whether direct or indirect), howsoever caused, even if foreseeable.
If we are liable to you for any reason, our liability is limited to the amount paid by you for the Service concerned. You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use our website and is compatible with our website. You also understand that we cannot and do not guarantee or warrant that any material available from our website will be free from infection, viruses and or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
Force majeure
We accept no liability for any failure or delay in supply or delivery or for any damage or defect to the Service supplied or delivered that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
Governing Law
These Terms shall be governed and construed in accordance with the laws of Israel, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our
Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days notice prior to any new terms taking effect. We determine at our sole discretion what constitutes a material change.nBy continuing to access or use our Service after those revisions become effective,
you agree to be bound by the revised terms. If you do not agree to the new terms, please, stop using the Service.
